Welcome to GoHostBiz ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of all GoHostBiz websites, services, products, applications, and tools (collectively, the "Services").

By accessing, browsing, registering, or purchasing any Service from GoHostBiz, you ("User", "you", "your", "customer") acknowledge that you have read, understood, and agree to be fully and unconditionally bound by these Terms, including any additional policies, guidelines, and amendments referenced herein.

Important Notice

If you do not agree with any part of these Terms, you must immediately discontinue use of our Services and must not register, purchase, or access any GoHostBiz product. Your continued use constitutes your express consent to these legally binding Terms.

These Terms apply to all users, including visitors, registered users, paying customers, and any individual or entity accessing our Services. These Terms constitute a legally binding contract between you and GoHostBiz, enforceable under the Indian Contract Act, 1872 and applicable laws.

Updates to Terms

GoHostBiz reserves the exclusive right, at our sole discretion, to modify, amend, update, or replace these Terms at any time without prior notification. All changes become effective immediately upon posting to our website. It is your sole responsibility to periodically review these Terms for any changes. Your continued use of our Services after any modifications constitutes your binding acceptance of the revised Terms.

Material Changes

For material or significant changes, we may, at our discretion, provide notification via email to the primary email address associated with your account or through a prominent notice on our website. However, such notification is a courtesy and is not legally required for the updated Terms to be enforceable.

2. Definitions & Interpretation

Content All data, files, text, images, videos, audio, software, code, scripts, databases, emails, and any other material stored, transmitted, or processed through our Services.
Server Resources CPU processing power, RAM (memory), disk storage space, bandwidth/network transfer, I/O operations, inodes (file count), entry processes, and database connections allocated to your hosting account.
Working Days Monday through Saturday, excluding public holidays observed in Uttar Pradesh, India.
Business Hours 9:00 AM to 9:00 PM Indian Standard Time (IST), Monday through Saturday. Emergency support is available 24/7 for critical server infrastructure issues.

3. Service Description & Scope

What we provide and the limits of our service

GoHostBiz provides a comprehensive range of digital services including but not limited to:

  • Shared Web Hosting: cPanel-based hosting on shared server environments with pre-configured software stacks including Apache/LiteSpeed, MySQL/MariaDB, PHP, and email services.
  • Cloud Hosting: High-availability hosting on clustered cloud infrastructure with resource isolation and automatic failover capabilities.
  • VPS Hosting: Virtual Private Servers with dedicated resource allocation, full root access, and customizable configurations running on KVM or OpenVZ virtualization.
  • Reseller Hosting: WHM-based hosting allowing customers to create and manage multiple cPanel accounts under their own brand.
  • Game Hosting: Specialized hosting plans for online gaming websites, including free premium source code as a bonus offering.
  • Student Hosting: Entry-level, budget-friendly hosting plans designed for students and learning purposes.
  • Domain Registration: Registration, transfer, and management of domain names through accredited registrars.
  • Website Development: Custom website design, development, and deployment services.

Service Modifications

GoHostBiz reserves the right to modify, upgrade, downgrade, suspend, or discontinue any Service, feature, or plan at any time without prior notice. We may change server hardware, software configurations, control panel versions, PHP versions, database engines, or any other technical aspect of our infrastructure. We will endeavor to provide advance notice for changes that may significantly impact your service, but such notice is not guaranteed.

Service Level & Performance

While GoHostBiz strives to maintain optimal performance and high availability, we do not guarantee uninterrupted, error-free, or continuous service. Interruptions may occur due to:

  • Scheduled maintenance, upgrades, or server migrations
  • Emergency maintenance required for security patches or critical fixes
  • Hardware failures, power outages, or data center incidents
  • Network attacks (DDoS), security breaches, or force majeure events
  • Third-party service failures (upstream providers, registrars, payment gateways)
  • Software bugs, compatibility issues, or configuration errors

4. Account Registration & Identity Verification

Requirements for creating and maintaining your account

Mandatory Accurate Information

When creating an account or making a purchase, you must provide complete, accurate, current, and truthful information including but not limited to:

  • Full Legal Name: Your complete first and last name as it appears on your government-issued identification. No aliases, pseudonyms, or abbreviated names.
  • Valid Email Address: An active email address that you own and regularly monitor. This will be our primary means of official communication regarding your account, billing, and service notifications.
  • Valid Phone Number: An active Indian mobile number capable of receiving calls, SMS, and WhatsApp messages for support and verification purposes.
  • Complete Billing Address: Your full residential or business address including street, city, state, and PIN code as per your official records.
  • Company Details (if applicable): If registering as a business entity, you must provide your company's legal name, GST registration number (if registered), and authorized representative details.

Fake Information — Zero Tolerance Policy

GoHostBiz maintains a strict zero-tolerance policy against fraudulent or fake account registrations. Any account found to contain false, misleading, or fraudulent information will face the following consequences:

  • Immediate Account Suspension: Without prior notice or warning
  • Permanent Service Termination: All services will be irrevocably terminated
  • Complete Refund Forfeiture: NO refund of any amount paid — the account is permanently ineligible for any refund under any circumstances
  • Legal Action: GoHostBiz reserves the right to report fraudulent registrations to law enforcement authorities under applicable Indian laws including the Information Technology Act, 2000 and the Indian Penal Code
  • Blacklisting: Your name, email, phone number, and IP address may be permanently blacklisted from all future GoHostBiz services
Account Security Responsibilities

You are solely and fully responsible for:

  • Maintaining the confidentiality and security of your account credentials (username, password, PIN)
  • All activities, actions, and transactions that occur under your account, whether authorized by you or not
  • Immediately notifying GoHostBiz of any unauthorized access, security breach, or suspected compromise of your account
  • Ensuring that all individuals with access to your account comply with these Terms

GoHostBiz Liability Disclaimer

GoHostBiz shall not be held liable or responsible for any loss, damage, or consequence arising from your failure to secure your account credentials, unauthorized use of your account, or any actions taken by individuals who gain access to your account through your own negligence. You agree to indemnify GoHostBiz against all claims arising from such unauthorized access.

One Person, One Account

Unless explicitly authorized in writing by GoHostBiz, each individual or legal entity is permitted to maintain only one account. Creating multiple accounts to circumvent restrictions, abuse promotional offers, evade suspension, or for any deceptive purpose is strictly prohibited and will result in all associated accounts being permanently terminated without refund.

5. Prohibited Activities & Content

Comprehensive list of forbidden uses on our platform

GoHostBiz strictly prohibits the use of our Services for any illegal, harmful, or abusive purposes. The following activities and content categories are expressly forbidden on ALL hosting plans, without exception. This list is illustrative and not exhaustive:

5.1 Illegal & Criminal Activities
  • Piracy & Copyright Infringement: Hosting, distributing, or linking to pirated software, cracked applications, nulled scripts, warez, copyrighted movies, music, books, games, or any intellectual property without explicit authorization from the rights holder.
  • Phishing & Fraud: Creating fake websites that impersonate banks, financial institutions, eCommerce platforms (Amazon, Flipkart, etc.), payment gateways, social media platforms, or any legitimate service with intent to steal credentials, financial information, or personal data.
  • Identity Theft: Using our services to collect, store, or distribute stolen personal information, identity documents, or financial data.
  • Child Exploitation Material: Hosting, distributing, or accessing any content related to child sexual abuse or exploitation — this results in immediate termination and mandatory reporting to law enforcement.
  • Terrorism-Related Content: Any content promoting, glorifying, or facilitating terrorist activities, extremist ideologies, or recruitment for illegal organizations.
5.2 Spam & Unsolicited Communications
  • Email Spam: Sending unsolicited bulk emails (UBE), commercial emails without consent, or any form of email spam through our servers.
  • SMS Spam: Using our infrastructure for bulk SMS campaigns to recipients who have not explicitly opted in.
  • Comment Spam: Automated posting of promotional comments on blogs, forums, or social media.
  • Purchased Email Lists: Sending emails to purchased, scraped, or harvested email lists — all recipient lists must be organically built with verified opt-in consent.
5.3 Malicious & Harmful Activities
  • Malware Distribution: Hosting or distributing viruses, trojans, ransomware, spyware, adware, keyloggers, botnets, or any malicious software.
  • Hacking Tools: Storing or distributing tools designed for unauthorized system access, password cracking, vulnerability exploitation, or network intrusion.
  • DDoS Attacks: Launching, coordinating, or facilitating Denial of Service attacks against any target, whether from our servers or using our infrastructure as a command-and-control center.
  • Port Scanning: Conducting unauthorized port scans, vulnerability assessments, or penetration testing against external systems.
  • Cryptocurrency Mining: Mining cryptocurrencies (Bitcoin, Ethereum, Monero, etc.) using server resources is strictly prohibited on shared, cloud, and reseller plans. Dedicated mining is only permitted on specially approved dedicated servers.
5.4 Resource Abuse & Unauthorized Services
  • Proxy/VPN Services: Running proxy servers, VPN services, TOR exit nodes, or anonymity networks without explicit written authorization.
  • File Hosting/Sharing: Operating file hosting services, mirror sites, download portals, cloud storage platforms, or file lockers.
  • Streaming Services: Hosting video streaming, audio streaming, live broadcasting, or media servers on shared/reseller plans. Streaming requires a VPS or dedicated server plan.
  • Torrent/P2P: Running torrent trackers, BitTorrent clients, or peer-to-peer file sharing applications.
  • IRC Servers: Operating Internet Relay Chat servers, bots, or bouncers.
  • Cron Job Abuse: Running cron jobs at intervals less than 15 minutes or cron jobs that consume excessive server resources.
5.5 Domain & SEO Abuse
  • Freenom Domains: Using .tk, .ml, .ga, .cf, .gq, or any Freenom-provided free domains on any GoHostBiz hosting plan. Such domains are associated with high rates of abuse and spam. Accounts using these domains will be immediately suspended without refund.
  • Black Hat SEO: Hosting doorway pages, link farms, scraper sites, spam blogs, or participating in any search engine manipulation schemes.
  • Domain Parking: Parking domains for monetization without active, legitimate websites.
5.6 Content Restrictions
  • Adult Content: Pornography, sexually explicit material, adult services, escort services, or any content of an overtly sexual nature.
  • Hate Speech: Content promoting discrimination, hatred, or violence against individuals or groups based on race, religion, ethnicity, gender, sexual orientation, disability, or any protected characteristic.
  • Violence & Gore: Graphic depictions of violence, gore, or content glorifying harm against humans or animals.
  • Illegal Substances: Content promoting, selling, or facilitating the sale of illegal drugs, controlled substances, or drug paraphernalia.
  • Weapons: Content promoting or facilitating the illegal sale or distribution of weapons, firearms, or explosives.

Enforcement & Penalties for Violations

  • First-Level Violation: Immediate service suspension with email notification. You may be given 24-48 hours to remove the violating content, at GoHostBiz's sole discretion.
  • Severe Violation (Illegal Content, Phishing, Malware, Child Exploitation): Immediate permanent termination without notice, no backup provided, no refund, and mandatory reporting to appropriate law enforcement authorities.
  • Repeated Violations: Permanent account termination and blacklisting from all future services.
  • Legal Consequences: You are solely liable for all legal consequences, damages, fines, penalties, and criminal prosecution arising from your prohibited activities. GoHostBiz will fully cooperate with law enforcement investigations.

6. Content Ownership & Responsibility

Your rights and responsibilities regarding hosted content

You retain full ownership of all content you create and upload to our servers. GoHostBiz does not claim any ownership rights over your content. However, by using our Services, you grant GoHostBiz a limited, non-exclusive license to host, store, transmit, and display your content solely as necessary to provide our Services to you.

Your Content Warranties

By uploading or hosting content on our servers, you represent and warrant that:

  • You own all rights to the content or have obtained all necessary licenses, permissions, and authorizations
  • Your content does not infringe upon any third-party intellectual property rights, privacy rights, or publicity rights
  • Your content complies with all applicable laws, regulations, and industry standards
  • Your content is not defamatory, obscene, or otherwise unlawful

7. User Behaviour & Support Interaction Policy

Standards of conduct when interacting with our team

GoHostBiz employs a professional, experienced, and dedicated support team committed to providing high-quality technical assistance. We believe in mutual respect between our team and our customers. All interactions with GoHostBiz staff — whether via support ticket, WhatsApp, phone call, email, live chat, or any other communication channel — must maintain professional and respectful standards.

Zero Tolerance — Abusive Behaviour

The following behaviors are strictly prohibited and will result in severe consequences:

  • Verbal Abuse: Using profanity, offensive language, slurs, insults, or derogatory remarks directed at our support staff
  • Threats: Threatening physical harm, legal action (without legitimate basis), financial harm, reputation damage, or any form of intimidation against our staff or company
  • Harassment: Repeated unwanted contact, stalking behavior, or excessive messaging beyond reasonable support needs (more than 10 messages per day on the same resolved issue)
  • Manipulation: Attempting to manipulate, coerce, or pressure support staff into providing unauthorized services, refunds, or special treatment
  • False Claims: Making false allegations about our services, staff, or company with intent to harm our reputation or extract undeserved compensation
  • Spam Contact: Sending the same message across multiple channels simultaneously or creating multiple tickets for the same issue
Consequences of Abusive Behaviour
  1. First Offense: Written warning via email. The abusive message will be documented in your account records.
  2. Second Offense: 48-hour account suspension. Support access restricted to ticket-only communication.
  3. Third Offense: Permanent account termination. All services irrevocably terminated. No refund provided. Account holder blacklisted from all future GoHostBiz services.
  4. Extreme Cases: Immediate permanent termination without warning if the abuse involves threats of violence, severe harassment, or criminal behavior. Legal action may be initiated.

Scope of Support

Our support team is trained and authorized to assist with:

  • Server infrastructure issues (downtime, errors, resource allocation)
  • Control panel functionality (cPanel, WHM, Plesk)
  • Email configuration and delivery issues
  • DNS management and domain configuration
  • Database management and optimization
  • PHP configuration and module installation
  • SSL certificate installation
  • Security-related concerns (malware scanning, firewall configuration)

Our support team is NOT responsible for:

  • Your website code, HTML, CSS, JavaScript, or PHP scripts
  • Third-party software, plugins, themes, or applications
  • Website design, content creation, or SEO optimization
  • Teaching you how to code or how to use specific software applications
  • Issues caused by your own modifications, customizations, or misconfigurations

8. Betting, Gambling & Legally Sensitive Websites

Special provisions for high-risk website categories

GoHostBiz acknowledges that certain website categories — including online betting, gambling, casino games, colour prediction, fantasy sports, rummy, poker, and similar real-money gaming platforms — operate in a legally complex environment in India. While we do not categorically ban such websites, they are subject to special provisions and stricter enforcement due to the elevated risk of legal complaints, regulatory action, and abuse reports.

Complaint Handling Process
  1. Complaint Receipt: Upon receiving any legal complaint, abuse report, regulatory notice, or law enforcement communication regarding your betting/gambling website, GoHostBiz will immediately notify you via email and/or WhatsApp.
  2. Resolution Window: You will be given exactly 24 hours from the time of notification to resolve the complaint. Resolution may include:
    • Providing valid legal documentation proving your compliance with applicable laws
    • Demonstrating valid licenses, registrations, or regulatory approvals
    • Removing the specific content that triggered the complaint
    • Taking other corrective action acceptable to GoHostBiz and the complainant
  3. Failure to Resolve: If the complaint is not satisfactorily resolved within 24 hours, your hosting account will be immediately suspended. Extended non-resolution (48+ hours) will result in permanent termination.

Extreme Circumstances — Immediate Termination

In the following extreme circumstances, GoHostBiz reserves the right to immediately suspend or permanently terminate your account WITHOUT any prior notice:

  • Receipt of a court order, judicial directive, or legal summons requiring content removal or service termination
  • Receipt of a formal complaint from CERT-In (Indian Computer Emergency Response Team), Cyber Crime Cell, or any government regulatory body
  • Receipt of a police complaint or FIR related to your website's activities
  • Evidence that your website is involved in fraudulent, deceptive, or clearly illegal gambling operations
  • Multiple unresolved complaints indicating a pattern of abusive or illegal behavior

Legal Liability Disclaimer

GoHostBiz functions solely as a hosting infrastructure provider. We do not operate, manage, endorse, or profit from the content or activities of our customers' websites. You, the customer, are solely and fully responsible for:

  • Ensuring your website complies with all applicable Indian laws, including the Public Gambling Act, 1867, Information Technology Act, 2000, and state-specific gambling regulations
  • Obtaining all necessary licenses, permits, and regulatory approvals for your operations
  • All legal consequences, fines, penalties, criminal liability, and civil damages arising from your website's content or activities
  • Defending, indemnifying, and holding GoHostBiz harmless against all claims, damages, and legal costs arising from your website

9. Source Code & Freebie Policy

Terms governing free source code provided with hosting plans

Nature of Source Code Provision

On select hosting plans — particularly Game Hosting plans — GoHostBiz may provide free premium source code (game scripts, website templates, application code) as a bonus, freebie, or promotional inclusion. This source code is offered at zero additional cost above the hosting plan price. The hosting plan fee you pay is for server resources and hosting infrastructure ONLY. The source code is a complimentary, non-monetary addition.

What You Are Paying For

When you purchase a Game Hosting plan or any plan that includes source code, your payment covers:

  • Server space (disk storage on our infrastructure)
  • Bandwidth and data transfer allowance
  • CPU and RAM resource allocation
  • Database hosting and management
  • Email services associated with your domain
  • cPanel/DirectAdmin control panel access
  • 24/7 technical support for server-related issues
  • SSL certificate (if included in plan)

The source code is an additional free inclusion, not a purchased product.

No Guarantees on Source Code

By accepting the free source code, you explicitly acknowledge and agree to ALL of the following:

Source Code Disclaimers

  • No Functionality Guarantee: GoHostBiz does not guarantee that the source code will function correctly on your specific server environment, domain, or configuration. The code is provided "AS IS" without warranties of any kind.
  • No Compatibility Guarantee: The source code may require specific PHP versions, database configurations, server modules, or software dependencies that may not be available or compatible with your hosting environment.
  • No Security Guarantee: GoHostBiz does not guarantee that the source code is free from security vulnerabilities, bugs, or exploits. You are responsible for securing and maintaining the code.
  • No Update Guarantee: The source code is provided in its current version. GoHostBiz is not obligated to provide updates, patches, or newer versions.
  • No Licensing Guarantee: While GoHostBiz endeavors to provide legally obtained code, we do not provide legal indemnification for intellectual property claims related to the source code.
No Technical Support for Source Code

Our technical support team does not provide assistance for:

  • Setting up, installing, or configuring the source code on your server
  • Debugging, troubleshooting, or fixing errors in the source code
  • Customizing, modifying, or enhancing the source code
  • Integrating the source code with third-party services, APIs, or payment gateways
  • Optimizing the source code for performance or security
  • Explaining how the code works or teaching you to use it

Professional Setup Service (Paid)

If you require professional assistance to set up, configure, or customize the source code, GoHostBiz developers are available for hire at a separate, mutually agreed-upon charge. This is an independent service engagement, not covered by your hosting plan. Contact us via WhatsApp or support ticket to request a quote for developer services.

Refund Rejection — Source Code Related

The following refund request reasons related to source code will be IMMEDIATELY and CATEGORICALLY REJECTED:

Non-Qualifying Refund Reasons

  • "Source code is not working"
  • "Source code has errors/bugs"
  • "I cannot set up the source code"
  • "Source code doesn't meet my expectations"
  • "Source code looks different from the demo"
  • "Source code requires features I don't have"
  • "I don't know how to use this code"
  • "The code is outdated"
  • "I found this code available for free elsewhere"
  • Any other reason primarily related to source code functionality, setup, or quality

The only source-code-related refund scenario is if GoHostBiz completely failed to deliver/send the source code to you at all. If the code was provided (regardless of its condition), the refund is invalid.

10. Backup & Data Retention Policy

How we handle backups and your responsibilities

GoHostBiz provides backup services as a convenience feature, not as a guaranteed service. While we maintain backup systems, you bear the ultimate responsibility for maintaining independent backups of all your data, websites, databases, emails, and content.

Critical Backup Limitations

  • 3 GB Threshold: Accounts storing more than 3 GB of data may not be reliably backed up by our automated systems. If your account exceeds 3 GB, you must maintain your own independent backups. GoHostBiz is not responsible for backup failures on accounts exceeding this threshold.
  • Database-Only Backups: For accounts over 5 GB, our system may only backup databases and configuration files, not the full file structure.
  • No Backup for Suspended Accounts: Accounts suspended for Terms of Service violations will not have backups available. Your data may be permanently deleted.
  • No Backup for Terminated Accounts: Permanently terminated accounts will have all data immediately and irrevocably deleted. No recovery is possible.
  • Backup Restoration: Backup restoration is a courtesy service and may take 24-72 hours depending on account size and support workload.

Your Backup Responsibility

Regardless of any backup services GoHostBiz provides, you are strongly advised and expected to maintain your own independent, off-site backups. We recommend:

  • Downloading weekly full cPanel backups to your local computer
  • Using automated backup plugins (if using WordPress, use UpdraftPlus, BackupBuddy, etc.)
  • Storing backups on cloud services like Google Drive, Dropbox, or Amazon S3
  • Testing your backups regularly to ensure they are functional and restorable

GoHostBiz shall not be held liable for any data loss, corruption, or unavailability, regardless of cause.

11. Payment, Billing & Renewal Terms

Financial obligations and payment policies

Billing Cycles & Invoicing

GoHostBiz offers various billing cycles including monthly, quarterly, semi-annual, annual, biennial, and triennial terms. By selecting a billing cycle, you commit to paying for the entire term. All fees are clearly displayed before checkout. Invoices are generated automatically and sent to your registered email address.

Automatic Renewal

Unless you explicitly disable auto-renewal or submit a cancellation request at least 7 days before your service expiry date, your services will automatically renew at the end of each billing period. The renewal will be charged to your default payment method at the then-current renewal price (which may differ from your initial purchase price due to promotional discounts expiring).

Non-Payment & Service Suspension
  1. Grace Period: After your service expires, a grace period of 3-7 days (depending on service type) may be provided during which your data is retained but your website may be suspended or display a "Service Expired" page.
  2. Suspension: After the grace period, your service will be fully suspended. Your website, emails, and databases will become inaccessible.
  3. Reactivation: Services can only be reactivated upon full payment of all outstanding dues. Payment promises or partial payments will not result in reactivation.
  4. Late Fees: A late reactivation fee may be charged for services reactivated after extended suspension.
  5. Permanent Termination: Services not renewed within the backup retention period (see Section 10) will be permanently terminated and all data irrevocably deleted.
Plan Downgrades & Changes

Downgrading from a yearly hosting plan to a monthly plan at the time of expiry is not permitted. If your yearly plan expires and you wish to continue service, the minimum renewal term is 3 months. Plan changes are at GoHostBiz's discretion and may incur migration or setup fees.

GST & Taxes

All prices displayed may be subject to applicable Goods and Services Tax (GST) as per Indian tax regulations. GST paid on services is non-refundable under any circumstances, including if a refund is issued for the base service amount. Chargeback Policy

Initiating a chargeback or payment dispute with your bank or payment provider without first contacting GoHostBiz to resolve the issue will result in:

  • Immediate suspension of all your services
  • Permanent account termination upon resolution of the dispute
  • Blacklisting from all future GoHostBiz services
  • You being held liable for all chargeback fees, recovery costs, and legal expenses

If you have a payment concern, always contact us first to seek resolution before initiating any dispute.

12. Suspension & Termination

Conditions and consequences of service suspension or termination

GoHostBiz reserves the right to suspend or terminate any service or account at our sole discretion, with or without notice, for any of the following reasons:

  • Violation of any provision of these Terms of Service
  • Non-payment of fees within the specified timeframe
  • Receipt of credible abuse complaints, legal notices, or law enforcement requests
  • Excessive consumption of server resources that degrades service for other customers
  • Fraudulent account information or payment fraud
  • Abusive behavior towards GoHostBiz staff
  • Any activity that poses a risk to our infrastructure, reputation, or legal standing

Consequences of Termination

  • All data, websites, emails, databases, and content will be permanently and irrevocably deleted
  • No backup will be provided (except in cases of non-payment within the backup retention period)
  • No refund will be issued for terminations due to Terms violations
  • Domain registrations associated with terminated accounts may not be transferable
  • You will be barred from creating new accounts or purchasing future services

13. Limitation of Liability

Scope and limits of our legal liability

To the maximum extent permitted by applicable law, GoHostBiz, its owners, employees, agents, affiliates, and contractors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

  • Loss of profits, revenue, business, or anticipated savings
  • Loss of data, content, or website functionality
  • Loss of goodwill or reputation
  • Cost of procurement of substitute services
  • Any damages arising from service interruptions, downtime, or data loss
  • Any damages arising from third-party actions, hacking, or security breaches
  • Any damages arising from your reliance on our Services

Maximum Liability Cap

In any event, GoHostBiz's total aggregate liability for any claims arising from or related to these Terms or our Services shall not exceed the total amount paid by you to GoHostBiz for the specific service giving rise to the claim during the three (3) months immediately preceding the event that gave rise to the claim. This limitation applies to all claims regardless of legal theory (contract, tort, negligence, strict liability, or otherwise).

14. Indemnification

Your obligation to defend and hold us harmless

You agree to fully indemnify, defend, and hold harmless GoHostBiz, its owners, directors, employees, agents, affiliates, and contractors from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of our Services
  • Your violation of these Terms of Service
  • Your violation of any applicable law, regulation, or third-party right
  • Your content, including any claims of intellectual property infringement, defamation, or privacy violations
  • Any disputes between you and your own customers, users, or visitors
  • Any claims arising from your prohibited activities as defined in Section 5

15. Governing Law & Dispute Resolution

Legal jurisdiction and dispute resolution procedures

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

Jurisdiction

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts located in Lucknow, Uttar Pradesh, India. You expressly consent to the personal jurisdiction and venue of these courts.

Mandatory Pre-Arbitration Negotiation

Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiations. The aggrieved party shall provide written notice to the other party describing the nature of the dispute and the desired resolution. Both parties shall have 30 days from receipt of such notice to resolve the dispute through negotiation. If resolution is not achieved within this period, either party may proceed with formal legal action.
